Privacy Statement

We respect and strive to protect your privacy. That is why we have adopted this Privacy Statement. We will take steps to use your personal information in ways that are compatible with this Privacy Statement. The following policies are only in effect for the Web pages, newsletters, discussion lists and opt-in announcement lists owned and operated by The Marden Companies1 (“Marden”). The following discloses our information gathering and dissemination practices for the following Web site: www.mardencompanies.com (the “Marden Network”)2.

What information are you collecting and how are you collecting it?

When you browse our Web site you do so anonymously. Every computer connected to the Internet is given a domain name and a set of numbers, which serve as that computer’s “Internet Protocol” (“IP”) address. When a visitor requests a page from any Web site within the Marden Network, our Web servers automatically recognize that visitor’s domain name and IP address. The domain name and IP address reveal nothing personal about you other than the IP address from which you have accessed our site. We use this information to examine our traffic in the aggregate, and to investigate misuse of the Marden Network or its authorized users, and to cooperate with law enforcement agencies. See also “Will you disclose the information you collect to outside third parties?” We do not collect and evaluate this information for specific individuals. Our Web servers do not automatically record e-mail addresses of the visitors. We will not collect any personally identifiable information about you (e.g., your name, address, telephone number or email address ("personal data")) through our websites unless you have provided it to us voluntarily. If you do not want your personal data collected, please do not submit it to us.

When you do provide us with personal data, we may use that information in the following ways, unless stated otherwise: we may store and process that information to better understand your needs and how we can improve our products and services. We may also use that information to contact you. We do not and do not intend to sell, rent or market personal data about you to third parties.

In some cases, when you connect to our site we may automatically (i.e., not via registration) collect technical information that is not personally identifiable. Examples of this type of information include the type of Internet Browser you are using, the type of computer operating system you are using and the domain name of the website from which you linked to our site.

Employment Information

When you express interest in employment with The Marden Companies, we will retain some personal information that provide to us and that we think is relevant to you as a potential employee. This information includes your name, address, telephone number, e-mail address, position of interest, discipline and if applicable, your application for employment. The Marden Companies may store this information for an indefinite period of time. Your employment application and personal information will only be used for purposes related to employment and will not be shared with third parties. Please note that specific provisions that appear on the Employment section of our Web site may further govern your submission of pre-employment information.

Personal Information

The Marden Companies may request site visitors to complete surveys or questionnaires that we have posted on the Web site. The information collected will be used to enhance the services and features of the Site. Disclosure of personal information is optional and will not be shared with third parties.

What are cookies?

From time to time, Marden may send a “cookie” to your computer. A cookie is a small piece of data that is sent to your Internet browser from our Web server and stored on your computer’s hard drive. A cookie cannot read data off of your computer hard disk or read cookie files created by other Web sites. Cookies do not damage your system. We use cookies to identify which areas of Marden’s Network you have visited or customized, so the next time you visit, those pages will be readily accessible. You can choose to accept cookies by changing the settings of your Internet browser. You can reset your browser to refuse all cookies, or allow your browser to show you when a cookie is being sent. If you choose not to accept these cookies, your experience on the Marden Network and other Web sites may be diminished and some features may not work as intended. We will not allow other sites or third parties to use our cookies.

How do you use single-pixel gifs?

Marden may use single-pixel gif images, sometimes referred to as Web bugs or Web beacons, to count the number of users accessing our site Web page and gather general statistical information. Marden does not gather personal information through the use of these images.

What information do you collect when I register for something?

Marden offers access to some services that require registration. We may use your registration information to send notification to you of Marden products and services by e-mail and/or postal mail. We may also share that information with our clients. Our clients may send you promotional material relevant to the services for which you registered. We may also use your IP address internally and share it with third parties. See Will you disclose the information that you collect to outside third parties?

What Information do you collect when I pay my bill on line?

Marden permits patients to pay their invoices for services on line through our Web Site. To make such online payments, you must register a user name and password and be accepted by us for on-line payment services. To complete your registration, you will also have to provide us with your patient identification number. Once registration is complete, you will receive e-mail confirmation. We store your user name and password to enable us to authenticate you as an authorized user of the online payment service.

Marden's on-line payment services are provided by First Data Merchant Services Corporation and Wells Fargo Bank N.A. (the "Payment Service"). We may change our processing service provider from time to time. We share with our Processing Service the online payment data you provide to us (including your name, address, credit card number or bank account number, payment instructions, if applicable, and similar information) over the Internet via Secure Socket Layer (SSL) encrypted connection. By using this Site to pay your invoices you consent to this method of transmitting your information. We not store such payment information on our systems once a payment transaction has been completed, but our Payment Service for customer service, audit, statement generation, payment reconciliation, problem solving, and similar purposes will store such information.

Marden uses commercially use reasonable measures to protect the security of the information you provide to us for online payment services. Our Processing Service has also agreed to such measures to protect the security and confidentiality of your information. But neither we nor our Processing Service guarantee the security and confidentiality of information sent over or through the Internet. Whenever you voluntarily transmit, or allow others to transmit, your information over or through the Internet you assume all of the risks inherent in doing so.

You are responsible for protecting your user name and password ("Authentication Information"). Neither Marden nor our Processing Service are liable for any loss or damage caused by or resulting from the unauthorized use of your Authentication Information by third parties, or due to any other circumstances beyond our reasonable control. For your protection, we and our Processing Service reserve the right to decline to process any transaction believed or suspected to be erroneous, unauthorized or otherwise irregular.

What other information do you request?

We may also request your e-mail address or mailing address for the purposes of conducting surveys or to provide additional services (for example, subscriptions to e-mail newsletters, announcement lists or information about conferences and trade shows). Whenever we request the identity of a visitor, we will indicate the purpose of the inquiry. We maintain a strict “No-Spam” policy that means that we do not sell, rent, or otherwise give your e-mail address to a third party, without your consent or as permitted by this Privacy Statement.

We may, from time to time, send e-mail announcing new Marden services or providing general information about Marden based on registration. Except as stated above, Marden will not send you e-mail that you have not agreed to receive. If you choose to supply your postal address in an on-line form, you may receive postal mailings from Marden and other third party companies.

When you register for a contest or other promotion, we may ask for your name, address, and e-mail address so we can administer the contest and notify winners.

When you use co-branded services, or those provided by a third party, within the Marden Network, your information may be passed to the co-brand or third party provider. Their use of your information is subject to their applicable privacy policies. You are responsible for reading and understanding the privacy policies of any third parties who co-brand services.

Will you disclose the information you collect to outside third parties?

Marden will disclose personal information and/or an IP address, when required by law or based upon a good-faith belief that such action is necessary to:

1. Cooperate with the investigations of purported unlawful activities and conform to the edicts of the law or comply with legal process served on the Marden Web sites;

2. Protect and defend the rights or property of the Marden Network and related properties, and the rights or property of visitors to the Marden Network and related properties;

3. Identify persons who may be violating the law or the Marden Legal Notice, the rights of third parties, or otherwise misusing the Marden Network or its related properties;

4. Fulfill a user’s order or request.

Marden uses reasonable precautions to keep the information disclosed to us secure. However, please understand that no transmission of data over the Internet or any wireless network can be guaranteed to be secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information that you transmit to us, therefore, you do so at your own risk.

Marden reserves the right to transfer all information disclosed to us in connection with the sale of all or part of Marden’s capital stock or assets. Furthermore, we are not responsible for any breach of security or for any actions of third parties that receive the information. We are not responsible for the privacy policies of third parties.

What else should I know about my privacy when on-line?

The Marden Network contains many hyperlinks to third party Web sites. The Marden Network may also contain third party advertisements. Marden is not responsible for the privacy practices or the content of such third party Web sites or advertisers. Marden does not share any of the individual personal information you provide Marden, with the third parties to which Marden links, except as stated elsewhere within this Privacy Statement. Marden, however, may share general, aggregate data with such third parties (such as how many people use our site). You are responsible for reviewing the privacy policies of any third parties.

Please keep in mind that whenever you voluntarily disclose personal information on-line – for example through e-mail, discussion lists, or elsewhere – that information can be collected and used by others beyond our control. In short, if you post personal information on-line that is accessible to the public, you may receive unsolicited messages from other parties in return.

Ultimately, you are solely responsible for maintaining the secrecy of your personal information. Please be careful and responsible whenever you’re on-line.

This Site provides you with the opportunity to opt-out of receiving communications from us at the point where we request information about you.
